Step 3: Eligibility is Determined
- IDEA requires that the task of determining eligibility be to "a group of qualified professionals and the parent" [§300.306(a)(1)].
- The school determines what constitutes a "qualified professional."
- This group may or may not be the same individuals who were involved in evaluating your child.
